Supreme Court says they will be watching Congress.
In an unsigned order on Monday, the Supreme Court declined to hear a case challenging the federal government’s male-only draft registration requirement as discriminatory against women.
But three of the justices added a statement that they will be watching Congress to see how it reacts. There have been suggestions in the legislature lately that draft registration requirements should be extended from just 18-year-old males to females as well.
Justice Sonia Sotomayor wrote, “It remains to be seen, of course, whether Congress will end gender-based registration under the Military Selective Service Act. But at least for now, the Court’s longstanding deference to Congress on matters of national defense and military affairs cautions against granting review while Congress actively weighs the issue.”
